Supreme Court issues show-cause order in Hitendra Dev Shakya's writ, seeks reply within 15 days
The Supreme Court has issued a show-cause order in response to a writ petition filed by former Executive Director of Nepal Electricity Authority, Hitendra Dev Shakya, demanding his reinstatement. The court has asked the government to respond within 15 days and scheduled a hearing on interim order for Ashoj 16.
Kathmandu. The Supreme Court has issued a show-cause order in response to a writ petition filed by Hitendra Dev Shakya, former Executive Director of the Nepal Electricity Authority, demanding his reinstatement to his previous position.
A single bench of Justice Kumar Regmi heard the petition and issued the show-cause order, asking the government to respond within 15 days. Additionally, a hearing on the interim order has been scheduled for Ashoj 16.
After the Supreme Court administration refused to register Shakya's writ, a bench of Justice Nripadhwaj Niraula on Friday ordered its registration.
In his writ, Shakya has demanded reinstatement to his previous position, arguing that the ordinance that removed him from office has already become inactive. The government on Tuesday registered a bill in the House of Representatives to reinstate the old legal provision that had become inactive due to the ordinance.
He was removed from office by the government on Ashoj 5, 2082. Later, after the Supreme Court ordered his reinstatement on Mangsir 22, 2082, Shakya was appointed as Executive Director of the Authority on Chaitra 11, 2081.
